Know Your Rights: A Student’s Guide to Constitutional and Legal Protections in India

New Delhil. ; In India, students are not governed by a separate set of laws alone instead, they are protected under the broader framework of the Constitution of India which guarantees fundamental rights to every citizen. These rights play a crucial role in ensuring that students are treated fairly, have access to education and can express themselves freely within academic spaces. However, awareness about these rights remains limited, making it important for students to understand what protections they are entitled to.

One of the most important rights is the Right to Education (Article 21A), which guarantees free and compulsory education for children aged 6 to 14 years. This is implemented through the Right to Education Act, 2009, ensuring that every child has access to basic schooling regardless of their socio-economic background. Beyond this, students are also protected by the Right to Equality (Article 14) which ensures that no student can be discriminated against on the basis of caste, religion, gender or background in educational institutions. Students also enjoy the Right to Freedom of Speech and Expression (Article 19), allowing them to voice opinions, participate in debates, and engage in academic discussions. However, this right comes with reasonable restrictions to maintain discipline and public order. Additionally, the Right to Information empowers students to access important academic details such as exam results, evaluation processes and institutional policies, ensuring transparency in the education system.

Apart from constitutional rights, students are also protected through various institutional and legal safeguards. These include the right to a safe and secure environment, protection from harassment, access to mental health support and the ability to participate in student bodies or peaceful protests. Colleges and schools are expected to maintain fairness in admissions, fees, and academic processes while respecting student privacy and dignity.
